General Terms and Conditions of Rent a Bike AG for long-term rentals

1. Scope of Application
These General Terms and Conditions apply to long-term rentals by Rent a Bike AG with a rental period of one month or longer.

2. Conclusion of the Contract
Rent a Bike AG (hereinafter referred to as the Lessor) rents bicycles or e-bikes of various brands to the customer (hereinafter referred to as the Lessee). These are the property of Rent a Bike AG. The rental agreement is concluded between the Lessor and the Lessee. The contract is concluded upon acceptance by the Lessor and after verification of eligibility.

3. Scope of the Contract
The rental fee covers the costs of using the vehicle for the duration of the contract.

4. Term
4.1 Fixed Contract Term

Long-term rentals can be arranged for a term of 1–12 months. Rental fees are charged based on the selected rental period and must be paid in full in advance (before taking possession of the e-bike/bicycle). The contract ends upon expiration of the fixed contract term.

4.2 Contract Extension
The contract may be extended for a maximum of 12 months at a time, up to a maximum rental period of 3 years. Termination in accordance with Section 14 remains reserved.

5. Rental Fee
5.1 Payment Terms

The rent is payable in advance by credit card.

5.2 Cancellation / Termination

The following cancellation terms apply:

  • Cancellation up to 21 days before the start of the long-term rental: 10% of the rental cost will be charged
  • Cancellation up to 8 days before the start of the long-term rental: 50% of the rental cost will be charged
  • Cancellation within 7 days prior to the start of the rental or no-show: 100% of the rental cost will be charged

In the event of early termination of the rental, there is no entitlement to a refund for the unused portion of the rental period.
A free cancellation or refund is generally only possible in the event of an accident or illness with a doctor’s note.

5.3 Late Payment
The tenant is in default without a reminder if payments are not made as agreed. From the due date, a late payment interest of 5% is owed on the amount due. If the tenant is sent a reminder due to a late payment, CHF 20.00 will be charged for each reminder. All other expenses incurred in connection with the collection of overdue claims shall be borne by the tenant. In any case, the lessor has the right to repossess the vehicle or have it repossessed in the event of non-payment.

5.4 Late Return
If the vehicle is returned late, a fee equal to one month’s rent for the selected vehicle category will be charged for each month or portion thereof.

6. Maintenance and Repairs
6.1 Maintenance Obligations

The lessee is obligated to take all necessary measures to preserve warranty and guarantee claims, and to maintain and care for the vehicle with due diligence.

6.2 Included Services
Repairs, the annual service, and restoration after the end of the rental period are the responsibility of the lessor. Damage resulting from excessive or improper use, as well as from insufficient maintenance during the rental period, will be charged to the lessee. Minor maintenance during the rental period is the responsibility of the renter.

6.3 Obligations of the Renter
The tenant must notify the landlord of any necessary repairs to the e-bike (with the exception of the replacement of wear-and-tear parts). For repairs to be borne by the lessor, the lessor may choose whether to repair the e-bike themselves or to have the lessee perform the repair. If the repair is left to the tenant, the tenant must visit a specialist dealer designated by the landlord and obtain a cost estimate. The tenant may not have the repair carried out until the landlord has given their approval.

7. Liability Insurance and “
” Protection Package 7.1 Liability

For vehicles with electric pedal assistance up to 45 km/h, mandatory liability insurance is included in the price. For e-bikes not requiring registration (motor assistance up to 25 km/h) and bicycles, it is the renter’s responsibility to obtain liability insurance.

7.2 Protection Package
The insurance applies:

  • Throughout Europe for collision and theft coverage.
  • In Switzerland and the Principality of Liechtenstein for assistancecoverage.


7.2.1 Included Services
The rental price includes a comprehensive coverage package that covers the following claims/events:

  • Unforeseen and sudden damage to or destruction of the rented bike resulting from an accident or fall during use.
  • Damage, destruction, or loss of the rented bike as a result of an attempted or completed theft.
  • In the event of a breakdown, the renter may make use of the included assistance. Coverage includes limitations on the roadworthiness of the rented vehicle resulting from a breakdown, an accident, or a dead battery.

Damage resulting from lack of maintenance is expressly excluded from the protection package and must be borne by the renter in accordance with section 6 above.

7.2.2 Deductible
The following deductible applies in the event of a claim:

  • Accident events: 10% of the claim costs, but at least CHF 100.00 per event
  • Theft incidents: CHF 500.00 per incident
  • Assistance: CHF 100.00 for a dead battery

7.2.3 Exclusions from the protection package
The following are not included in the protection package:

  1. Damage resulting from fire or natural hazards;
  2. Damage resulting from permanent, foreseeable factors such as aging (including the normal decline in performance of batteries and light sources), wear and tear, corrosion, or excessive buildup of rust, mud, or other deposits;
  3. Damage for which the manufacturer or seller is legally or contractually liable (warranty claims);
  4. Damage to accessories of any kind that are not permanently mounted on the vehicle.
  5. Damage resulting from acts of war, terrorism, or civil unrest of any kind, and measures taken in response thereto;
  6. Damage resulting from vandalism;
  7. Cosmetic damage such as paint scratches or dents;
  8. Theft in the absence of adequate anti-theft measures customary in the area;
  9. Losses due to misplacement or loss;
  10. Damage resulting from official orders, confiscations, or strikes;
  11. Claims arising from damage that was highly likely to occur or was accepted as a risk;
  12. Damage occurring during participation in racing events and related training;
  13. Damage for which proof of loss cannot be provided;
  14. Damage resulting from events that had already occurred at the start of the insurance coverage;
  15. Damage and defects attributable to inadequate maintenance or failure to follow the manufacturer’s recommended maintenance procedures;
  16. Damage and defects attributable to improper use of the insured bike as defined by the manufacturer’s specifications;
  17. Damage caused by gross negligence or intentional conduct;
  18. Damage covered by other insurance policies;
  19. Damage resulting from the commission of criminal offenses or an attempt thereof; and
  20. Damage resulting from intoxication, drug abuse, or misuse of medication.
  21. Damage to and theft of the trailer towed by the bike
  22. Damage resulting from excessive wear and tear or due to lack of maintenance (Sections 6.1–6.3)

7.3. Assistance
In the event of a breakdown, the renter may make use of the included assistance. Coverage applies to situations where the rented vehicle is unable to be driven due to a breakdown, an accident, or a dead battery.

A breakdown is defined as mechanical or electrical defects in the rented vehicle that make it impossible or legally impermissible to continue driving, as well as key-related malfunctions (the lock cannot be opened properly, or the key or lock is damaged).

The following applies to the provision of these services:

  • Assistance services are provided only if the rented vehicle is located on a road accessible to emergency vehicles in Switzerland or the Principality of Liechtenstein at the time of the assistance event.
  • If a repair is possible at the location of the assistance event, the repair will always be performed only at that location.
  • If repairs cannot be performed at the location of the assistance incident, repairs will always be carried out at the nearest repair shop, provided this can be done within three hours. If repairs cannot be completed within three hours, repairs may also be performed at the user’s regular repair shop. If neither the nearest repair shop nor the user’s regular repair shop is open, the rented vehicle will be transported to the current residence of the user of the rented vehicle.
  • Compensation is limited to a maximum of CHF 500.

7.4 Procedure in the Event of a Claim
Procedure in the event of accidents, theft, extended warranty claims, or assistance requests:

In the event of a late report, the lessor will not cover any costs.

7.5 Data Protection
For the duration of the rental, the vehicle is insured in the name and on behalf of the lessor, and the lessor is the sole beneficiary of this insurance.

To verify coverage in the event of a claim, the lessor will provide the lessee’s contact information, as well as the make, model, and chassis number of the leased vehicle, to Helvetia Swiss Insurance Company AG, which will process this data in accordance with its privacy policy (available at: http://www.helvetia.ch/datenschutz).

8. Liability of the Lessor
The lessor assumes no liability toward the lessee or third parties for accidents or damage occurring during the rental period. Likewise, the lessor is not liable for damage resulting from defects in the vehicle, to the extent permitted by law. The statutory warranty provisions and warranty services of the vehicle manufacturer remain reserved.

The renter is entitled to a replacement vehicle if the rented vehicle has been stolen or is permanently inoperable, provided that the renter is not at fault. The rental fee remains due until the end of the contract.

9. Liability of the Renter
9.1 Compliance with Legal Requirements for the Use of E-Bikes and S-Pedelecs

The renter must ensure that the e-bike provided under the contract is used in compliance with the law. In particular, the minimum requirements regarding age and driver’s license must be observed and compliance with them ensured.

Pursuant to Art. 18 of the Ordinance on Technical Requirements for Road Vehicles (VTS), the following rules apply to the operation of e-bikes:

  • E-bikes with a maximum speed of 25 km/h are classified as light motorized bicycles and may be ridden by individuals aged 16 and older without a driver’s license. A Category M driver's license is required for riders aged 14–16. Riding an e-bike is strictly prohibited for anyone under the age of 14.
  • S-pedelecs with assistance up to 45 km/h are classified as motorized bicycles. They may be ridden by individuals aged 16 and older who hold at least a Category M driver’s license (or higher).

Rent a Bike AG disclaims any liability arising from non-compliance with these regulations.

9.2 Additional Obligations Regarding Use
The renter is obligated to use, store, and lock the vehicle with due care, to comply with all legal regulations related to the ownership, use, or maintenance of the vehicle, and to follow the manufacturer’s maintenance, care, and usage recommendations.

The renter is obligated to take all necessary measures to maintain the warranty and guarantee claims.

The renter is liable for all fines incurred in connection with the use of the vehicle, such as driving the vehicle by an unauthorized driver, disregarding driving bans, using the vehicle for a prohibited purpose, and any other penalties for which the lessor is held liable, unless they were caused by the lessor’s fault.

The renter may not make any modifications to the vehicle that cannot be removed with minimal effort and without leaving permanent marks. Upon termination of the rental agreement, the renter is obligated to restore the vehicle to its original condition at their own expense. If this is not done, the lessor may have the vehicle restored at the renter’s expense.

The renter is expressly advised of the temperature sensitivity of the vehicle’s batteries. The renter is obligated to store the vehicle with the batteries in accordance with the manufacturer’s specifications at all times in such a way that there is no risk of temperature-related damage.

9.3 Commercial Use
Without the express permission of the lessor, the lessee is prohibited from using the e-bike for commercial purposes or in the course of professional activities. Courier services of any kind are expressly prohibited. The renter is not authorized, without the lessor’s permission, to transfer the use of the rental item to a third party, in particular to sublet it. Commercial subletting of the e-bike is prohibited in all cases.

9.4 General Restrictions
Any misuse of the e-bikes (e.g., using a city bike on mountain bike trails), transporting one or more additional persons on the luggage rack, and riding over obstacles where the vehicle could obviously be damaged is prohibited.

Participation in sporting events or competitions, whether in the private, amateur, or professional sphere, including associated practice and training rides as well as rides intended to achieve maximum speed (including downhill rides), is prohibited.

10. Return of the Vehicle
10.1 Return to the Pickup Location

Upon termination of the contract, the renter must return the vehicle to the rental location immediately. If this obligation is not fulfilled, the lessor is entitled, upon termination of the contract, to collect the vehicle or have it collected by an agent at the renter’s expense.

10.2 Condition of the Vehicle
The vehicle must be returned clean, in fully functional condition, and with all accessories such as keys, charger, owner’s manual, etc. A corresponding checklist will be provided to the renter.

11. Disposal of the Vehicle
The vehicle may not be sold, pledged, or encumbered with third-party rights.

The renter is obligated to grant the lessor or its representatives access to the vehicle during normal business and operating hours or at a reasonable time of day.

12. Early Termination of the Rental Agreement
The Lessor may terminate this agreement at any time with immediate effect for good cause. The following events, in particular, constitute good cause: a) if the lessee is at least three months in full or partial default on payment obligations under this agreement despite a reminder warning of legal consequences and setting a grace period of 14 days; b) if the lessee violates material contractual provisions, in particular those set forth in Sections 6 through 8; c) in the event of total loss, loss of the vehicle, or complete destruction (repair costs exceeding the value of the vehicle). In this case, the lessee will be billed for the residual book value of the vehicle. d) in the event of the lessee’s death or legal incapacity; e) in the event of the cessation of business operations, or the relocation of the lessee’s company headquarters or residence outside of Switzerland.

13. Changes of Address
The lessee must immediately notify the lessor in writing of any changes to their name, residence, or company headquarters. Until such notification is provided, notices from the lessor may be sent with legal effect to the last verifiable address provided by the lessee.

14. Privacy Policy
Rent a Bike and its contractual partners undertake to process the personal data collected only within the scope of the contract and not to disclose it to third parties.

Rent a Bike and its contractual partners are responsible for ensuring that persons involved in data management and processing maintain confidentiality and shall ensure that no one can gain unauthorized access to personal data.

15. Venue of Jurisdiction
The courts in Willisau shall have jurisdiction over any disputes arising from this contract. Swiss law shall apply.
